Terms and Conditions
Updated 5 November 2026
1. Introductory provisions
These Terms and Conditions (the ‘Terms’) govern the rights and obligations between the service provider, Filip Zemek, business ID (IČO) 23584203, with registered address Drnovec 1, 471 54 Cvikov, an entrepreneur entered in the Trade Register maintained by the Municipal Office in Nový Bor (the ‘Provider’), and the user (the ‘User’). The service is available at www.fasthdr.cz and provides automated digital photo editing using artificial intelligence under the name FastHDR (the ‘Service’). The Service is primarily intended for businesses and self-employed professionals (B2B: photographers, real estate agents and companies). Where the User acts as a consumer (an individual acting outside their business), the relevant provisions of Act No. 89/2012 Coll., the Czech Civil Code, and Act No. 634/1992 Coll., on Consumer Protection, apply.
2. Purpose of the Service and permitted content
The Service is intended exclusively for professional editing of real estate photographs (interiors, exteriors, land, floor plans and related property images) for real estate listings, property marketing and professional real estate photography. The User agrees to upload only photographs within the category described above. Uploading any other content — particularly portraits of people, intimate images, document photographs, illegal content, material infringing third-party rights or content other than real estate photographs — is prohibited. Technically, uploads are limited to image files in JPG, PNG, TIFF, WEBP, HEIC and RAW formats (ARW, CR2, CR3, NEF, DNG and others). The system rejects other file types during upload. The Provider reserves the right to terminate the account and delete the data of a User who violates these rules, without compensation. The content restriction applies to photographs submitted for AI editing. It does not apply to a custom profile photo or logo stored in account settings; these images are not sent to the AI editing service.
3. User account and registration
Registration is required to use the Service. The User is responsible for ensuring that the billing and contact information provided is accurate and truthful. The User must protect their sign-in credentials and prevent third-party access to their account. The Provider is not responsible for damage caused by unauthorized use of the account by a third party.
4. Payment terms
Photo processing and viewing the preview before payment are free. A one-time payment gives the User the ability to download selected finished photos at full resolution without a watermark. For HDR, the price applies to the finished photo, not to each source exposure. Current pricing is available on the Provider's website. On the website, a one-time payment is made through the GoPay payment gateway. In the iOS app, you confirm the purchase in the system App Store payment interface and Apple processes the payment. The actual price and currency are shown before you confirm the purchase. The Service does not operate on an automatically renewing subscription or prepaid credit basis. The contract between the Provider and the User is formed when payment is successfully completed. After verifying payment, the Provider makes the selected finished photos available to download without undue delay. The User can view the edited previews before paying. Given the nature of AI image processing, the Provider does not guarantee that the editing result will always meet the User's subjective expectations. Payment for an edit is final and non-refundable. A refund may be issued only in the event of a demonstrable technical failure on the Provider's side where the photo was not processed or could not be downloaded.
5. Withdrawal from the contract
As the Service consists of supplying digital content made available at full resolution without a watermark at the User's request after payment verification, the consumer has no right to withdraw from the contract within 14 days under section 1837(l) of the Czech Civil Code if performance began with their express consent before the withdrawal period expired. The User gives this consent by selecting the relevant checkbox before completing the order, with the following wording: ‘I agree to the Terms and Conditions and expressly request delivery of digital content before the withdrawal period expires. I acknowledge that this causes me to lose my right to withdraw from the contract.’ Refunds are possible only in the event of a demonstrable technical failure by the Provider (see section 4). Send refund requests to info@fasthdr.cz.
6. Copyright and uploaded data
The User is fully responsible for having the right to upload photographs to the Service and for ensuring that their processing does not infringe copyright or other third-party rights. Uploading photographs does not grant the Provider any permanent copyright. Data is used solely to perform the requested edit once. Retention: unpaid photos are available for 7 days after upload. Paid photos are available for 7 days after payment. After availability ends, we remove originals and results through automatic cleanup. For a shared HDR set, source exposures are retained until the availability of the last paid result ends. The User is responsible for downloading results within this period.
7. Complaints and liability for defects
If the Service is defective (a photo was not processed or a result cannot be downloaded), the User may submit a complaint to info@fasthdr.cz within 30 days of payment. The Provider undertakes to resolve the complaint within 30 days of receipt. Subjective dissatisfaction with the AI editing result (aesthetics or style) is not grounds for accepting a complaint, as the result depends on the nature of the source material and the processing parameters selected by the User.
8. Service availability
The Provider strives to keep the Service continuously available but does not guarantee 100% availability. Planned outages will be announced on the website. The Provider is not responsible for outages caused by third parties, such as hosting services or payment gateways.
9. Personal data protection
Personal data processing is governed by the separate Privacy Policy available at fasthdr.cz/ochrana-soukromi.
10. Final provisions
The Provider is not liable for direct or indirect damage resulting from temporary unavailability of the Service, loss of unsaved data (after the 7-day period) or the User's improper use of edited photographs. The Provider may change these Terms unilaterally. The User will be informed by email or a notice on the website. Continuing to use the Service after changes take effect constitutes acceptance of the new Terms. All legal relationships are governed by Czech law. Any disputes will be handled by the court in the Czech Republic with subject-matter and territorial jurisdiction. A User acting as a consumer has the right to out-of-court resolution of a consumer dispute arising from this contract. The competent body is the Czech Trade Inspection Authority (Česká obchodní inspekce), Štěpánská 567/15, 120 00 Praha 2, business ID 00020869, www.coi.cz. This text was updated on 5 November 2026. It clarifies previews before payment, access to paid results, purchases in the iOS app, and the use of profile photos and logos.
